1. Introduction
Welcome to BreezeMintCorner ("we," "us," or "our"). These Terms & Conditions ("Terms") are a binding contract governing your usage of our yacht charter services and the website available at breezemintcorner.site, operated by BreezeMintCorner.
When you reserve a charter or use our Service, you are agreeing to these Terms. Should you not agree with any aspect of these terms, then you are not authorized to use the Service.
2. Service Overview
BreezeMintCorner offers a range of high-end yacht charter services, which include, but are not limited to:
- Yacht hire for the day
- Evening pleasure cruises
- Exclusively arranged retreats for enterprises
- Personal celebrations
- Extended excursions over multiple days
All services provided are subject to both availability and prevailing weather conditions. We maintain the right to modify or cease services without prior notice at any time.
3. Booking and Reservations
3.1 Booking Process
For reservation of a yacht charter, you are required to:
- Be at least 18 years old
- Submit accurate and up-to-date information
- Make the necessary deposit as outlined in your reservation confirmation
- Accept these Terms & Conditions
3.2 Confirmation
A booking is deemed confirmed upon our receipt of your payment and our issuance of a written confirmation. Service may be refused to any individual at our sole discretion.
3.3 Availability
All charters are dependent on the availability of the vessel and appropriate weather conditions. We will endeavor to meet your requested dates and timing to the best of our ability.
4. Payment Terms
4.1 Pricing
Pricing is quoted in € and includes all applicable taxes, unless specified otherwise. Prices may change without prior notification.
4.2 Payment Schedule
- Initial Deposit: 50% of the overall charter fee due upon booking
- Final Payment: The remaining balance to be paid no later than 48 hours prior to the charter's departure
- Incidental expenses (if applicable): To be settled at the conclusion of the charter
4.3 Payment Methods
Accepted methods of payment include major credit cards, direct bank transfers, and certified cheques. Our payment processing is secured via encrypted gateways.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- If canceled by the customer more than 72 hours before departure: A full refund less processing fees
- If canceled by the customer within 24-72 hours before departure: A 50% refund
- If canceled by the customer less than 24 hours before departure: No refund will be issued
5.2 Weather Cancellations
Should our captain determine that weather conditions are unsafe, we will offer:
- An alternative charter date at no added cost or
- A full refund in case rescheduling is not a viable option
5.3 Mechanical Issues
In the event of mechanical failure involving the designated vessel, we will seek to arrange a suitable replacement. Where a substitute is not available, we will issue a complete refund.
6. Safety and Conduct
6.1 Safety Requirements
All guests must:
- Heed all instructions provided by the crew
- Wear the safety equipment as instructed
- Disclose any medical conditions affecting their safety
- Keep within designated areas on the vessel
6.2 Prohibited Items
The following are not allowed onboard:
- Bottles made of glass
- Unlawful substances
- Weapons of any kind
- Excessive quantities of beverages that can intoxicate
- Pets, unless with prior authorization
6.3 Conduct
Passengers are expected to behave respectfully. A charter may end prematurely without a refund if behavior of any passenger poses a risk to safety or interferes with the experience of others.
7. Liability and Insurance
7.1 Our Liability
Our liability to you is limited to the cost paid for the charter. We are not liable for:
- Injuries to individuals arising from their own negligence
- Lost or damaged personal possessions
- Indirect, incidental, or punitive losses
- Delays resulting from conditions beyond our control or inclement weather
7.2 Insurance Coverage
Comprehensive marine insurance is held by us to cover our vessels and operational activities. It is the responsibility of passengers to ensure they have adequate travel and personal insurance cover.
7.3 Assumption of Risk
By availing of our charters, you accept that activities at sea involve inherent dangers and agree to be accountable for your personal safety and actions.
8. Modifications and Itinerary Changes
We hold the right to adjust itineraries, routes, or timetables due to safety concerns, weather-driven considerations, or operational necessities. We will strive to offer equivalent alternatives if changes are made.
9. Force Majeure
Events beyond our control, such as severe weather, natural catastrophes, regulatory acts, harbor terminations, or mechanical breakdowns, do not leave us liable for delays, cancellations, or alterations to service.
10. Privacy and Data Protection
Your private data will be managed in compliance with our Privacy Policy. Using our services is consenting to the gathering and use of your information as outlined within our Privacy Policy.
11. Intellectual Property
All content displayed on our website, including written materials, imagery, brands, and icons, is safeguarded by copyright and trademark regulations. Unauthorized reproduction, dissemination, or creation of derivative products is prohibited without our explicit written consent.
12. Governing Law
The applicable laws of Spain govern these Terms. Any legal disputes will be subject to the jurisdiction of courts in Barcelona, Spain.
13. Changes to Terms
